Terms of Use

This is an English translation for convenience. The Czech version is the binding one.

1. Operator and agreement to the terms

The Na pivo app is operated by Tomáš Mach, Záryby, company registration number (IČO): 22006401 (hereinafter “we” or “the operator”). Contact: tomades1@gmail.com.

These terms govern the use of the Na pivo mobile app. By downloading and using the app you agree to them; when you create an account, you confirm them on the registration screen. If you do not agree with the terms, do not use the app.

The app is free. We grant you a non-exclusive, non-transferable licence to use it for personal, non-commercial purposes on devices you own or control.

2. What Na pivo is

Na pivo is a beer diary with a compass. It covers finding pubs nearby, a direction arrow and a map, the Beer Diary (beers logged, visits, ratings, evenings and photos) and a community side: Crew and public profiles, community meet-ups, a photo contest, an AI beer menu scan, leaderboards and badges, and community mapping of pubs (opening hours, beers on tap, amenities).

The core features work without an internet connection; community and synced features need a connection and an account. We keep developing the app, so its look and the range of its features can change.

3. Age 18+ and alcohol

The app is meant solely for people who are at least 18 years old. By using the app and creating an account you confirm that you are at least 18.

The app revolves around beer, so one thing bluntly: drink responsibly and never drive under the influence of alcohol. Do not use the app while driving. Counters, leaderboards and badges are statistics and fun, not an encouragement to drink. The app gives no health advice and calls no number of beers safe.

4. Accounts

The app creates an anonymous device account; on top of that you can create a registered account by email or through Google or Apple, and you can link and unlink sign-in methods.

You undertake to give truthful details, not to impersonate another person and to protect your login credentials. You are responsible for activity carried out under your account.

You can delete your account at any time in the app. Once requested, it is deactivated for 14 days (you can restore it by signing in) and then permanently deleted, and with it your contributions about pubs and the public meet-ups you hosted. Pub data from other people stays, that is not your account data. Without your identity, only the necessary moderation records and parts of other people’s shared content can remain. 5. Your content

Content you put into the app (photos, texts, ratings, pub details) stays yours. So that we can run the app, you grant us a non-exclusive, royalty-free licence to store the content, process it technically (for example format conversion and thumbnails), display it and distribute it within the app according to the visibility you chose (private, Crew, public). The licence lasts until you delete the content or your account.

Only upload content you hold the rights to: your own photos, and with the consent of people who are recognisable in them.

6. Rules of conduct

The following is prohibited in the app:

  • unlawful content and conduct; any child sexual abuse and exploitation (CSAE) content is absolutely prohibited, we delete such content and report it to the relevant authorities;
  • hateful, threatening, violent or pornographic content;
  • harassing others, impersonating another person, spam and publishing other people’s personal data without their consent;
  • content infringing copyright or other third-party rights;
  • deliberately false information about pubs and manipulation of leaderboards, votes or experience points;
  • reverse engineering the app, disrupting its operation, automated abuse of the API and circumventing limits.

7. Moderation and reporting

You can report objectionable content, a profile or a meet-up straight in the app; you can also block a user, which hides your interactions from each other. We assess reports manually. If these terms are breached, we can hide or remove content, limit account features, or suspend or cancel the account.

To keep leaderboards fair, we use simple automatic rules: a record that looks implausible (going over the daily limit, a suspiciously fast series, a backdated entry) does not count towards public leaderboards and statistics. Your private diary is not affected by this.

If you disagree with our action, write to us at the contact email and we will get back to you without undue delay.

8. Community meet-ups

Meet-ups in the app are organised by users themselves. We are neither their organiser nor a participant and we are not responsible for how they go. The host is responsible for the accuracy of the details about the meet-up and for it being lawful; attendance is voluntary and at your own risk. Meet-ups are only for people who are at least 18 years old. Dangerous, unlawful or deceptive meet-ups are prohibited and we can hide or cancel them.

9. Photo contest

Only enter your own photos that meet the rules of conduct. An entered photo is publicly visible, voting included. Vote honestly: manipulating the vote means disqualification. We can disqualify a photo that breaks the rules, and we can change or end the contest at any time.

10. AI beer menu scan

The “Snap the menu” feature uses AI and its output can be wrong or incomplete. Check it before you save or publish it. The feature may not always be available. How the photo is processed is described in the Privacy Policy.

11. Accuracy of the information

Information about pubs comes from our directory, from the community and from external sources. We do not guarantee that opening hours, prices, the beer selection, the location or the very existence of a venue are accurate and current. The direction arrow is indicative and depends on the sensors in your phone. External navigation (Apple Maps, Google Maps, Mapy.cz) is governed by the terms of that app.

12. Availability and changes to the service

We can change, limit or discontinue features of the app and we cannot promise that the service will run without interruption. We will announce the discontinuation of a substantial feature or of the whole service in advance in the app or on this page, and we will let you request an export of your data.

13. Liability and complaints

The app is provided “as is”. We are not liable for content created by users, for how community meet-ups go, for the output of AI features, for decisions made on the basis of information in the app, or for the loss of data that did not manage to sync during an outage.

Nothing in these terms limits the rights the law gives you that cannot be excluded by contract, in particular consumer rights, liability for personal injury and liability for intent or gross negligence.

Report service defects and complaints through the contact email. Consumer disputes can also be resolved out of court by the Czech Trade Inspection Authority (coi.gov.cz, the adr.coi.cz platform).

14. Governing law

These terms are governed by the law of the Czech Republic. If you are a consumer habitually resident in another country, this choice does not deprive you of the protection given to you by the mandatory provisions of the law of your country of residence.

15. App Store and Google Play

We distribute the app through the Apple App Store and Google Play; alongside these terms, the rules of the relevant store apply too.

For downloads from the App Store the following also applies: these terms are an agreement between you and the operator, not with Apple. Apple is not responsible for the app, its maintenance or its support, and has no obligation to handle any claims connected with the app. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you. You represent that you are not located in a country under a US government embargo and that you are not on any government list of prohibited or restricted parties.

16. Changes to the terms

We will make minor changes to the terms by updating this page and the date in the header. We will announce material changes in advance in the app or by email, if we have one for your account. If you do not agree with the changes, stop using the app; you can delete your account at any time.
